Q. 3인이 토지를 함께 매입하여 개발 후 분양하는 부동산매매업(공동사업, 면세)을 하던 중 폐업과 동시에 미분양 토지를 각자 분배받아 구분등기하는 경우 신고방법
A. 공동사업(면세사업자)을 폐업하고 남은 토지와 샘플하우스를 개인별로 분할하여 소유하는 경우 다음과 같이 처리해야 할 것으로 보입니다.
1. 소득세
공동사업의 재고자산을 개인에게 분할등기한 경우 소득세법 제25조 제2항(가사용 재고자산)에 따라 부동산의 시가를 공동사업장의 총수입금액에 산입해야 할 것으로 보입니다.
2. 부가가치세
공동사업자가 샘플하우스를 개인에게 이전한 경우 그 샘플하우스가 면세사업에서 우연히 일시적으로 공급한 것이라면 부가가치세법 제14조(부수 재화 및 부수 용역의 공급)에 따라 면세대상인 것으로 보아야 할 것 같습니다. 그러나 샘플하우스가 부가가치세 과세사업에서 우연히 일시적으로 공급한 것이라면 주된 사업에 따라 과세대상으로 보아야 할 것 같습니다. 샘플하우스가 어떤 사업의 재화인지 판단해서 처리하시기 바랍니다.
